In a landmark decision, Virgin Australia has been ordered to reinstate an employee, “DM,” after the Fair Work Commission ruled in his favor. DM, who worked for Virgin Australia from July 2022 until February 2024, was dismissed for alleged “professional misconduct,” including claims of being hungover and breaching alcohol rules. Virgin Australia also scrutinized DM’s personal life, including a Grindr hookup during a layover, which they used to justify his dismissal. The Commission criticized Virgin’s handling of fatigue management and found the termination harsh. Commissioner Pearl Lim noted that similar situations would not have been scrutinized if DM were straight. #Queer Up Social Justice
